Providing nursing care for people with dementia residing in long-term care facilities poses specific challenges regarding pain practices. With underlying communication barriers unique to dementia pathologies, this population is often unable to communicate verbal sentiments and descriptions of pain. In turn, nurses caring for older persons with dementia have difficulty assessing, managing and treating pain. Objectivity is an imperative factor in healthcare pain practices; however, it is difficult to objectively evaluate someone who cannot accurately communicate their experience of pain. Therefore, (...) the authors believe that subjectivity is also an essential part of evaluating the person with dementia's experience of pain. In this critical reflection, the authors explore objectivity and subjectivity in relation to pain practices for dementia in long-term care. A historical summary of pain is provided outlining the evolution of objectivity and subjectivity related to pain practices. The authors discuss the complexities of assessing and managing pain and offer a new perspective about the role of objectivity (and co-existence of subjectivity) for nurses treating pain in the older adults with dementia. _Purpose:_ In order to develop an evidence-based, sport-specific minimum impairment criteria (MIC) for the sport of vision-impaired (VI) shooting, this study aimed to determine the relative influence of losses in visual acuity (VA) and contrast sensitivity (CS) on shooting performance. Presently, VA but not CS is used to determine eligibility to compete in VI shooting. _Methods:_ Elite able-sighted athletes ( n = 27) shot under standard conditions with their habitual vision, and with their vision impaired by the use of simulation (...) spectacles (filters which reduce both VA and CS) and refractive blur (lenses which reduce VA with less effect on CS). Habitual shooting scores were used to establish a cut-off in order to determine when shooting performance was ‘below expected’ in the presence of vision impairment. Logistic regression and decision tree analyses were then used to assess the relationship between visual function and shooting performance. _Results:_ Mild reductions in VA and/or CS did not alter shooting performance, with greater reductions required for shooting performance to fall below habitual levels (below 87% of normalized performance). Stepwise logistic regression selected CS as the most significant predictor of shooting performance, with VA subsequently improving the validity of the model. In an unconstrained decision tree analysis, CS was selected as the sole criterion (80%) for predicting ‘below expected’ shooting score. _Conclusion:_ Shooting performance is better predicted by losses in CS than by VA. Given that it is not presently tested during classification, the results suggest that CS is an important measure to include in testing for the classification of vision impairment for athletes competing in VI shooting. Kant's Critique of Pure Reason, his main work of theoretical philosophy, frequently uses metaphors from law. In this first book-length study in English of Kant's legal metaphors and their role in the first Critique, Sofie Møller shows that they are central to Kant's account of reason. Through an analysis of the legal metaphors in their entirety, she demonstrates that Kant conceives of reason as having a structure mirroring that of a legal system in a natural right framework. Her study shows (...) that Kant's aim is to make cognisers become similar to authorized judges within such a system, by proving the legitimacy of the laws and the conditions under which valid judgments can be pronounced. This paper explores the control of visiting “foreign scientists” at the Charles Darwin Research Station (CDRS) after it was established in the Galápagos Islands in 1959. Scholarly accounts of the creation of the Galápagos National Park and of the field station have emphasized their place in an international “land grab,” as leading scientists and conservationists sought to control nature in places around the world that seemed less “civilized” to European thinkers. The actual administrative labor in the early years at this (...) scientific field station, however, in practice struggled to control people widely taken to represent “civilization” in its highest form—European and American scientists. At the research station, European and American (but not Ecuadorian) scientists were the focus of a delicate choreography of discipline and acquiescence, as scientists were courted and refused, welcomed and limited, chastised and supported. Meanwhile CDRS fund-raising appeals promised that the station would control island residents, fishing crews, and invasive species. Such appeals did not mention controlling elite field scientists. Existing historiography has stressed how Western scientists were privileged actors in non-Western nature reserves and parks, their privileges coming at the expense of local communities. But scientists too faced new (quietly implemented) constraints as post-war conservation programs developed, and achieving their compliance with these new rules involved a process I call here “civilizing” elites. While we know this path usually entails financial sacrifices and hard work, very little attention has been paid to the deep personal compromises such students have to make as they enter worlds vastly different from their own. This article proposes a neurobiologically motivated theory of meaning as internal representation that holds on to the principle of compositionality, but negates the principle of semantic constituency. The approach builds on neurobiological findings regarding topologically structured cortical feature maps and the mechanism of object-related binding by neuronal synchronization. It incorporates the Gestalt principles of psychology and is implemented by recurrent neural networks. The semantics to be developed is structurally analogous to some variant of model-theoretical semantics. The semantics to be developed (...) is a neuro-emulative model-theoretical semantics of a first-order language. The model-theoretical semantics is merely denotational and does not imply anything about the structures of the mind or the underlying neural mechanisms that enable producing and comprehend meaningful expressions. All illness represents a state of diminished autonomy and therefore the doctor-patient relationship necessarily and justifiably involves a degree of medical paternalism argues the author, an American medical student. In a broad-ranging paper he discusses the concepts of autonomy and paternalism in the context of the doctor-patient relationship. Given the necessary diminution of autonomy which illness inflicts, a limited form of medical paternalism, aimed at restoring or maximising the patient's autonomy is entirely acceptable, and indeed fundamental to the relationship he (...) argues. However, the exercise of this paternalism should be flexible and related to the current 'level of autonomy' of the patient himself. An editorial in this issue comments briefly on this paper. This edited volume represents a unique addition to the available literature on animal ethics, animal studies, and neuroethics. Antonio Gramsci's _Prison Notebooks_ have offered concepts, categories, and political solutions that have been applied in a variety of social and political contexts, from postwar Italy to the insurgencies of the Arab Spring. The contributors to _Gramsci in the World_ examine the diverse receptions and uses of Gramscian thought, highlighting its possibilities and limits for understanding and changing the world. Among other topics, they explore Gramsci's importance to Caribbean anticolonial thinkers like Stuart Hall, his presence in decolonial indigenous movements in (...) the Andes, and his relevance to understanding the Chinese Left. The contributors consider why Gramsci has had relatively little impact in the United States while also showing how he was a major force in pushing Marxism beyond Europe—especially into the Arab world and other regions of the Global South. In this paper, I analyze the verbal suffix -uŋil in Washo as an optional past tense. It is optional in the sense that it is not part of a paradigm of tenses, and morphologically tenseless clauses are also compatible with past time reference. Specifically, I claim that -uŋil is the morphological exponent of a tense feature [past], which presupposes that the reference time of the clause, denoted by a temporal pronoun, precedes the evaluation time. Meanwhile, morphologically tenseless clauses lack a (...) semantic tense restricting the value of the reference time pronoun. In comparing this analysis with one containing a covert non-future tense in morphologically tenseless clauses, I show that the range of empirical contexts that distinguish these analyses is quite narrow. However, I offer a novel argument against a covert tense analysis based on the lack of Maximize Presupposition effects. Crucially, the fact that -uŋil does not form a paradigm of tenses results in a failure for Maximize Presupposition to apply. The proposed analysis places cross-linguistic variation at the level of the paradigm of tense features, namely whether they are present or absent, and if present, whether obligatorily so. This case study from Washo thus reveals what a language where tense features are optional can look like, and more generally contributes to the growing body of literature on cross-linguistic semantics devoted to uncovering the ways in which temporal interpretation can be achieved in natural language. In Australia and other countries, certain groups of women have traditionally been denied access to assisted reproductive technologies . These typically are single heterosexual women, lesbians, poor women, and those whose ability to rear children is questioned, particularly women with certain disabilities or who are older. The arguments used to justify selection of women for ARTs are most often based on issues such as scarcity of resources, and absence of infertility , or on social concerns: that it “goes against nature”; (...) particular women might not make good mothers; unconventional families are not socially acceptable; or that children of older mothers might be orphaned at an early age. The social, medical, legal, and ethical reasoning that has traditionally promoted this lack of equity in access to ARTs, and whether the criteria used for client deselection are ethically appropriate in any particular case, are explored by this review. In addition, the issues of distribution and just “gatekeeping” practices associated with these sensitive medical services are examined. (shrink)

Language is central to political philosophy, yet until now there has been little in the way of a common framework capable of bridging disciplines that share an interest in language, power, and ethics. Studies are predominantly carried out in isolated disciplinary silos - notably linguistics, philosophy, political science, public administration, and education. In an individualistic society and in the increasingly competitive business environment people do not seem inclined to forgive others their trespasses. One is more likely to choose to ignore the virtue of forgiveness as a way of handling personnel situations involving intense conflict or mild disagreements, favoring instead the negative feelings of resentment, anger, revenge or retaliation. Business people seem less concerned with growth in virtue and character; interestingly they allow their character and ultimately their work relationships to deteriorate because (...) they hold onto feelings of anger and resentment. Is there a place for forgiveness in our interpersonal relationships in general and in corporate life in particular? I believe there is. A study of the virtue of forgiveness shows that it is a misunderstood virtue, but one that deserves attention. In this article I will examine the virtue of forgiveness, defining what forgiveness is and is not, and will illustrate how it might be situated as an essential human resource management strategy. This philosophy is based on quality-of-life studies which are becoming an important topic of research in behavioral and social sciences (basic and applied research). This paper addresses the QOL orientation in marketing from a decision-making perspective. Specifically, this paper shows how marketers can engage in strategic marketing planning guided by the QOL concept.

Este trabajo se inscribe en una revisión in progress del Derecho antidiscriminatorio moderno que las autoras vienen efectuando desde hace más de tres lustros. En la primera parte del mismo se examinan los textos de una f ilósofa política y de dos juristas esta- dounidenses (I. M. Young, C. A. MacKinnon y K. Crensahw) que inspiran la propuesta de un concepto de discriminación y de una visión de la interseccionalidad basados en el reconocimiento de los sistemas de opresión. La segunda (...) parte se centra en el análisis del concepto de discriminación múltiple o interseccional propuesto por la doctrina jurídica española a partir de la jurisprudencia referida al caso de una mujer (“La Nena”) casada por el rito gitano que ve denegada su pensión de viudedad. The failure to maintain a canonical Christian understanding of the family as a microcosm of the church oriented toward deification instead of a microcosm of society aimed at social ends has opened Christians up to an uncritical adoption of non-Christian approaches in medical decision making. This article begins by identifying the Christian family crisis not as a liberal versus conservative debate centered on the form and function of the family, but more fundamentally as an ecclesial versus sociological understanding of the (...) Christian family. The article presents a historical sketch of the circumstances that have led to this contemporary crisis in the Western Christian family, followed by an analysis that provides a canonical account of the Christian family as exemplified in the thought of Gregory the Theologian. This article concludes by looking at the specific issue of labor and delivery in the United States, and the implications for a canonical Christian understanding of labor and delivery in light of contemporary medical practices. Background: Neonatal nurses report a great deal of ethical challenges in their everyday work. Seemingly trivial everyday choices nurses make are no more value-neutral than life-and-death choices. Everyday ethical challenges should also be recognized as ethical dilemmas in clinical practice. Research objective: The purpose of this study is to investigate which types of ethical challenges neonatal nurses experience in their day-to-day care for critically ill newborns. Research design: Data were collected through semi-structured qualitative in-depth interviews. Phenomenological-hermeneutic analysis was applied to (...) interpret the data. Participants and research context: Six nurses from neonatal intensive care units at two Norwegian hospitals were interviewed on-site. Ethical considerations: The study is designed to comply with Ethical Guidelines for Nursing Research in the Nordic Countries and the Helsinki declaration. Findings: Findings suggest that nurses experience a diverse range of everyday ethical challenges related to challenging interactions with parents and colleagues, emotional strain, protecting the vulnerable infant, finding the balance between sensitivity and authority, ensuring continuity of treatment, and miscommunication and professional disagreement. Discussion: A major finding in this study is how different agents involved in caring for the newborn experience their realities differently. When these realities collide, ethical challenges arise. Findings suggest that acting in the best interests of the child becomes more difficult in situations involving many agents with different perceptions of reality. Conclusion: The study presents new aspects which increases knowledge and understanding of the reality of nursing in a neonatal intensive care unit, while also demanding increased research in this field of care. I show that conceptual philosophical anarchism, the claim that law cannot give reasons for action, is entailed by several popular theories about law. Reductionists about practical authority believe that all supposedly legitimate practical authority reduces to forms of theoretical authority. They tend to embrace anarchism, but some readers might not be clear why. Trigger theorists about reason-giving believe that all reason-giving merely activates pre-existing conditional reasons. Natural lawyers hold that all legal reasons are sourced in the natural law, which entails (...) that positive law cannot provide reasons for action. If you are attracted to any of these theories and still think that positive law creates new practical reasons, you might have to give up one or the other position. If anarchism is entailed by believing the normativity in law’s directives pre-dates the directive, only a few may be able to avoid it, Hans Kelsen, Mark Greenberg, and Joseph Raz being the most likely. While moral philosophy has traditionally been understood as an examination of the good life, this book argues that ethical inquiry should, rather, begin from an examination of evil and other 'negative' moral concepts, such as guilt and suffering.

Under the assumption that all "rules" are recursive (ECT) the statement $\operatorname{Cont}(N^N,N)$ that all functions from N N to N are continuous becomes equivalent to a statement KLS in the language of arithmetic about "effective operations". Our main result is that KLS is underivable in intuitionistic Zermelo-Fraenkel set theory + ECT. Similar results apply for functions from R to R and from 2 N to N. Such results were known for weaker theories, e.g. HA and HAS. We extend not only (...) the theorem but the method, fp-realizability, to intuitionistic ZF. (shrink)
